  • The enhanced status program for female contractors (such as WOSB, MWBE) will continue unabated with the 28th Amendment (Equal Rights), just like those same programs are allowed to give enhanced status to minority-owned businesses even though racial equality is protected under the 14th Amendment.
  • The 28th Amendment, like all other constitutional rights, is not absolute. The government will just have to prove it has a good reason for making a distinction based on sex. Helping marginalized groups succeed with targeted programs is a good reason.
